Workers’ Compensation and Social Security Disability

If you receive workers’ compensation benefits and Social Security disability benefits, your Social Security disability benefits may be reduced (offset).  Many times, the calculation of the workers’ compensation offset performed by SSA is incorrect.  Other times, it is not calculated for quite some time, resulting in an overpayment of benefits.  If you have a workers’ compensation case and a Social Security disability claim, it is important that your attorney understand the interaction between the benefits.  If you have two attorneys, they need to work together.  Moreover, if you settle or receive a trial judgment for your workers’ compensation case, it is usually paramount that appropriate language be used in the Order to ensure that any reduction/offset of Social Security benefits is minimized to the fullest extent possible.   If you were injured on the job and are now disabled, feel free to contact my office.  My contact information is here.
